Terms & Conditions

Terms & Conditions

Effective Date: August 23, 2026 | Last Updated: August 23, 2026

These Terms & Conditions (“Terms”) govern your access to and use of www.theleanmachinesd.com (the “Site”) and any products, meals, services, content, or communications offered by The Lean Machine Meal Prep (a California business entity) (“The Lean Machine,” “we,” “us,” or “our”) (collectively, the “Services”). Please read them carefully.

By accessing or using the Services, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Services.

1. Eligibility & Acceptance

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to purchase from us or use the Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Changes to These Terms

We may modify these Terms at any time. Revised Terms become effective when posted, and we will update the “Last Updated” date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.

3. Permitted Use & Prohibited Conduct

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes in accordance with these Terms. You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Violate any applicable law, regulation, or third-party right;
  • Copy, reproduce, scrape, harvest, or republish any part of the Services, including menus, recipes, nutrition data, and photography, without authorization;
  • Resell or commercially redistribute meals purchased from us without our prior written consent;
  • Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to our systems;
  • Interfere with or disrupt the integrity, security, or performance of the Services;
  • Use automated means (bots, crawlers) except as permitted by our robots.txt;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Use the Services to transmit unsolicited or unauthorized advertising or spam.

4. Orders, Cutoff Times & Changes

All orders are subject to acceptance and availability. Each delivery and pickup date has an order cutoff, which is stated on our Delivery & Pickup Options page and at checkout at the time you order. Changes, additions, and cancellations must be made before the applicable cutoff for that order. After the cutoff, ingredients have been purchased and preparation has begun, and orders may no longer be changed or cancelled except at our discretion and subject to any cancellation fee disclosed at the time of ordering.

We reserve the right to refuse or cancel any order, correct pricing errors, limit quantities, and terminate accounts, including where we believe an order is fraudulent, violates these Terms, or cannot be safely fulfilled.

5. Delivery, Pickup & Risk of Loss

We deliver only within our published San Diego County service area. Delivery availability and fees are determined by your ZIP code and are shown on our Delivery & Pickup Options page and at checkout. Delivery days, delivery windows, and pickup locations and hours are as published on that page and may change.

You do not need to be present to accept a delivery, but access to your front door is required. You are responsible for providing an accurate delivery address, a phone number that can receive text messages, and any gate or entry codes in the notes field at checkout. Risk of loss and title pass to you when your order is delivered to the address you provided or collected at your selected pickup location.

Delivery windows are estimates and are not guaranteed. We are not responsible for delays or losses caused by inaccurate delivery information, inaccessible delivery locations, weather, traffic, or other events outside our reasonable control. If a delivery cannot be completed for reasons within your control, you are responsible for arranging to collect your meals as directed, and we cannot guarantee the condition of meals left unattended or not promptly refrigerated.

Pickup locations are operated by independent partner businesses. You must collect your order during that location’s posted pickup hours. Orders not collected during the posted window may be discarded for food-safety reasons without refund.

6. Food Safety, Storage & Handling

Our meals are freshly prepared, perishable, and contain no preservatives. You are responsible for refrigerating your meals promptly after delivery or pickup. Store meals at 40°F or below and consume them within five (5) days of the prepared date printed on each meal. Meals you do not intend to eat within that window should be frozen; frozen meals should be consumed within ten (10) days, must be eaten immediately after thawing, and must not be refrozen. Insulated bags and ice packs are provided as a convenience for transport only and are not a substitute for refrigeration.

We are not responsible for spoilage, illness, or loss resulting from meals that are not promptly refrigerated, are stored or reheated improperly, or are consumed after the recommended period.

7. Allergens & Dietary Information

Our menu items are prepared in a shared kitchen. While all of our menu items are prepared gluten free and we do not use pork, shellfish, or mushrooms, we cannot guarantee that any item is free from cross-contact with allergens. Certain items contain soy, and certain items contain dairy; allergen and nutrition information is published on our nutrition information pages and on individual menu items.

If you have a food allergy, sensitivity, or medical dietary restriction, you must notify us in writing before ordering, and you accept the risk of cross-contact inherent in a shared kitchen. If you cannot accept that risk, please do not order.

8. Not Medical or Nutritional Advice

Nutrition information, macronutrient data, meal descriptions, and any wellness content on the Site are provided for general informational purposes only and are not medical, nutritional, or dietary advice. They are not a substitute for consultation with a licensed physician or registered dietitian. Consult your healthcare provider before beginning any diet, meal plan, or fitness program, and particularly if you are pregnant or nursing, are managing a health condition, or are ordering on behalf of a minor. Nutrition values are estimates based on standard ingredient data and may vary between batches.

9. Accounts & Registration

Some features, including ordering and subscriptions, require an account. You may maintain only one account, may not transfer your registration, and are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Pricing & Payment

Menu items, ingredients, pricing, delivery fees, and availability are subject to change without notice and may vary by season and supply. We strive for accuracy but do not warrant that descriptions, nutrition data, pricing, or other content are error-free.

We accept major credit and debit cards, PayPal, and other methods offered at checkout. Payments are processed by our third-party payment processors. You authorize us and our payment processor to charge your selected payment method for the full order total, including any applicable delivery fee and tax. If a payment is declined, charged back, or reversed, we may suspend or cancel the related order and any account privileges.

Sales tax. Cold prepared food sold for consumption off our premises is generally not subject to California sales tax, and we do not add sales tax to meal orders. Where any item or charge is taxable under applicable law, tax is calculated and disclosed at checkout.

11. Returns, Refunds & Order Issues

Because our meals are freshly prepared perishable food, meals that have been delivered or picked up cannot be returned and are not refundable. Changes and cancellations made before the applicable order cutoff are handled as described in Section 4.

If there is a problem with your order — a missing or incorrect item, or an item that arrives in unacceptable condition — contact us at orders@theleanmachinesd.com or (619) 381-5468 within 24 hours of delivery or pickup, with your order number and, where possible, a photograph. We will work with you in good faith to correct the issue by replacement, account credit, or refund at our discretion. Gift cards are non-refundable.

12. Subscriptions & Auto-Renewal

If you enroll in a recurring meal subscription, your payment method will be automatically charged for each recurring order on the schedule you select, at the then-current subscription price, until you cancel. Subscription discounts apply only while the subscription is active.

You may skip, pause, modify, or cancel your subscription at any time from your account on the Site, or by contacting us at orders@theleanmachinesd.com or (619) 381-5468. Cancelling is as easy as signing up. A change or cancellation takes effect for the next order whose cutoff has not yet passed; orders already past their cutoff will still be prepared and charged. We will provide advance notice of any subscription price increase as required by law.

13. Promotional Codes, Referrals & Gift Cards

Discount codes, referral credits, and promotional offers are subject to the terms stated at the time of issuance, may not be combined unless expressly stated, have no cash value, are non-transferable, and may be modified or discontinued at any time. Discounts described as available to specific groups may require verification of eligibility.

Gift cards sold by The Lean Machine Meal Prep do not expire and carry no dormancy or inactivity fees, consistent with applicable California law. Gift cards are redeemable only toward our products, are not reloadable unless stated otherwise, are not redeemable for cash except where required by law, and are not replaceable if lost or stolen unless required by law. Balances can be checked using the method provided on the Site.

14. Intellectual Property

The Services and all content, features, and functionality — including text, menus, recipes, nutrition data, graphics, logos, images, designs, software, and trademarks — are owned by or licensed to The Lean Machine Meal Prep and are protected by U.S. and international copyright, trademark, and other intellectual-property laws. All brand, product, and service names of third parties appearing on the Site are the trademarks of their respective holders, and reference to them does not imply affiliation or endorsement. Except for the limited license granted in these Terms, no rights are transferred to you. You may not use our name, logos, or trademarks without our prior written consent.

15. User Content & Submissions

If you submit reviews, comments, photos, testimonials, or other content (“User Content”), you retain ownership but grant The Lean Machine Meal Prep a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, display, and distribute that User Content in connection with the Services and our business, including on our website and social channels. You represent that you own or control all rights to your User Content and that it does not violate these Terms or any third-party rights. We may moderate or remove User Content at our discretion.

16. Third-Party Links & Services

The Services may contain links to or integrations with third-party websites, products, or services that we do not control, including our payment processors and pickup partners. We provide these for convenience only and do not endorse and are not responsible for their content, policies, or practices.

17. Disclaimers of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE LEAN MACHINE MEAL PREP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY MEAL, MEAL PLAN, OR NUTRITION INFORMATION WILL PRODUCE ANY PARTICULAR HEALTH, WEIGHT, OR FITNESS RESULT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE LEAN MACHINE MEAL PREP OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

19. Indemnification

You agree to indemnify, defend, and hold harmless The Lean Machine Meal Prep and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, your failure to store or handle meals as directed, your failure to disclose an allergy or dietary restriction, or your violation of these Terms or any law or third-party right.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 21, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue there.

21. Arbitration & Class-Action Waiver

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, rather than in court, except that either party may bring a claim in small-claims court. Arbitration will take place within 100 miles of your residence unless the parties agree otherwise. You and The Lean Machine Meal Prep agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by notifying us in writing at anthony@theleanmachinesd.com within 30 days of first accepting these Terms.

22. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.

23. Miscellaneous

  • Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede all prior communications and proposals.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
  • No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our consent; we may assign them freely.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Electronic Communications. We may communicate with you electronically by email, text message, or notices posted on the Site, and you agree that such communications satisfy any legal requirement that a communication be in writing.
  • Void Where Prohibited. Although the Site is accessible worldwide, our products and services are offered only where we are able to lawfully provide them, and any offer is void where prohibited.
  • Headings. Section headings are for convenience only and have no legal effect.
